Placement Terms and Conditions
The following terms and conditions are between 5 Star Nannies, Inc. and its Client. The “Client” is the individual named on the Family Application form. The “Candidate” refers to the person introduced by 5 Star Nannies, Inc. for purposes of employment.
The terms and conditions specified below are accepted by the Client by virtue of the engagement of a Candidate introduced by 5 Star Nannies, Inc.
- 5 Star Nannies, Inc. will introduce a Candidate to the Client according to the requirements of the Client as stated on the application form.
- The Client, upon engaging a candidate introduced by 5 Star Nannies, Inc. will immediately notify 5 Star Nannies, Inc. of the hiring decision.
- The fee for a permanent placement is 15% of the first year’s net salary of the Candidate, or $1,500 (for nannies) or $500 (for housekeepers), whichever is greater.
- All fees are due and payable within seven (7) days of invoice by 5 Star Nannies, Inc. All fees must be paid prior to commencement of the Candidate’s employment.
- 5 Star Nannies, Inc. will endeavor to ensure, but does not guarantee, the suitability of any candidate introduced to the Client. The Client shall satisfy himself/herself as to suitability of any candidate before engaging the Candidate. The Client will be responsible for obtaining any necessary work permits and for paying any employment or payroll taxes that may be required.
- 5 Star Nannies, Inc. accepts no liability whatsoever for any loss arising either directly or indirectly from any act or omission of any candidate introduced by 5 Star Nannies, Inc. including negligent or fraudulent acts or omissions.
- In the event that the Client or Candidate terminates the engagement within 90 days of the Candidate’s starting employment, 5 Star Nannies, Inc. will provide a free replacement.
- Every effort will be made to find a suitable replacement provided the following conditions are met:
- The Client must notify 5 Star Nannies, Inc. in writing of the termination within five days thereof.
- The Client will not engage the Candidate within six months of the termination.
- The engagement must not have been terminated due to unreasonable conditions.
- Also, the termination must not be due to conditions different from those stated in the contract of employment or on the Client’s application form.
- The Client must notify 5 Star Nannies, Inc. if a temporary placement extends beyond that originally agreed with 5 Star Nannies, Inc. In such case, an additional fee for a permanent introduction will be payable by the Client.
- In the event that the Client introduces the Candidate to another person who subsequently hires the Candidate, the Client is liable to pay a placement fee to 5 Star Nannies, Inc.
